Delaware Consumer Fraud Act (6 Del.C. § 2511 et seq.)

Prohibits deceptive or fraudulent practices in the sale or advertising of goods, establishes a private right of action, and provides for enforcement through injunctions, damages, and other remedies.

About the Legislation:

It is an unlawful practice for a person to use deception, fraud, false pretense, false promise, misrepresentation, or an unfair practice or to conceal, suppress, or omit a material fact with intent that others rely upon such concealment, suppression, or omission in connection with the sale, lease, receipt, or advertisement of any merchandise, whether or not any person has in fact been misled, deceived, or damaged.

Private Right of Action: Yes.
Damages/Enforcement: Restraining orders, injunctions, appointment of a receiver and administration of an estate, costs, and/or damages.
